Consequently, tenants and landlords frequently disagree over who is responsible for what in terms of damage and repairs. Both tenants and landlords must know their rights and responsibilities when renting regarding property maintenance and how damage repairs will be handled.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Warranty of Habitability<\/h1>\n\n\n\n<p>As per Landlord-Tenant Law, landlords are obligated to ensure that the rental properties they provide meet certain livability standards. Examples of urgent repairs landlords must attend to include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Structural issues<\/li><li>Electrical issues<\/li><li>Plumbing issues<\/li><li><a href=\"https:\/\/fourwalls.rentler.com\/2022\/02\/07\/are-you-or-your-landlord-responsible-for-pest-problems\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pest infestations<\/a> (unless caused by tenant neglect)<\/li><li>Faulty heating systems in winter<\/li><li>Faulty exterior locks and doors<\/li><li>Mold&nbsp;<\/li><\/ul>\n\n\n\n<p>Property owners are responsible for rectifying any issues affecting a tenant&#8217;s health and safety. Once a landlord receives a maintenance request, they should immediately evaluate the urgency of the request and address the issue within 24 hours if it affects the property&#8217;s habitability.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>When is a tenant liable for repairs?<\/strong><\/h2>\n\n\n\n<p>Tenants are responsible for keeping a <a href=\"https:\/\/fourwalls.rentler.com\/2022\/09\/22\/how-to-make-a-rental-feel-like-a-forever-home\/\" target=\"_blank\" rel=\"noreferrer noopener\">rental property<\/a> in the same condition as when they moved in. It may seem unfair, given that it was not your actions that caused the damage, but the person was in your home with your permission, so you are technically responsible for repairing any damage they caused.<\/p>\n\n\n\n<p>While your landlord can (and almost certainly will) hold you directly responsible for the damage, you can seek to recoup those losses by requesting that the guest in question cover those expenses. This visitor could be a friend, family member, acquaintance, contractor, business associate, or client &#8211; regardless of who they are, if they are at your request and consent, their actions are your responsibility. If the party who caused the damage refuses to pay for the repairs, it may be necessary to sue for property damage in small claims court.<\/p>\n\n\n\n<p>If you decide to sue for property damage via a small claims court, you must research how the system operates in your particular state. The Statutes of Limitations for property damage claims also vary significantly between states, so you must learn the rules that apply to your state&#8217;s small claims system.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Can a Security Deposit Cover Repair Costs?<\/strong><\/h2>\n\n\n\n<p>A security deposit is a monetary deposit paid by a tenant at the start of their tenancy to <a href=\"https:\/\/lodgable.com\/vacation-rental-damage-deposit\/\" target=\"_blank\" rel=\"noreferrer noopener\">cover any damages<\/a> or other losses incurred by the landlords as a result of their actions (or inactions). Landlords may also keep some or all of the deposit to cover any rental payment arrears. After vacating the property, a tenant should receive a full refund of the deposit amount as long as the property is left in good condition with no repairs needed and rent is paid on time.<\/p>\n\n\n\n<p>In most states, the laws governing <a href=\"http:\/\/fourwalls.rentler.com\/tag\/security-deposits\/\" target=\"_blank\" rel=\"noreferrer noopener\">security deposits<\/a> allow landlords to retain funds from a security deposit to cover the expense of rectifying damage or excessive uncleanliness.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What Can be Deducted from a Security Deposit?<\/strong><\/h3>\n\n\n\n<p>Landlords must allow for normal wear and tear, but any additional damage can be deducted from the tenant&#8217;s security deposit.
